show moreAround 6:43 AM on January 21, 2024, officers with the Clearwater Police Department were dispatched to a motor vehicle crash at 2045 Gulf to Bay Boulevard. As the officers arrived on scene, they observed that a 2010 Hyundai Sonata had penetrated in a southwesterly pathway through the office of Greenberg Dental and also damaged the seating area of Skyline Chili after going through a wall. The building sustained extensive damages estimated to be over $200,000.
The driver, identified as 22-year-old Danya Trejo, was escorted over to an ambulance rig operated by Sunstar Paramedics and evaluated by first responders. After she was evaluated, she declined further medical attention and indicated that she did not wish to go to the hospital. After she declined medical attention, Officer Alex Krolick informed her that he was changing over to a DUI investigation and read her Miranda rights. Based on his suspicion of impairment, Danya was asked to perform field sobriety exercises.
Danya had admitted to first responders that she had consumed alcohol in the hours prior, and she also admitted to Officer Krolick that she had consumed alcohol before operating a motor vehicle. Officer Krolick started with the Horizontal Gaze Nystagmus (HGN) test, where he observed the lack of smooth pursuit and HGN at maximum deviation in both eyes. The second exercise was the Walk and Turn test, and Danya did not touch heel-to-toe on each step and turned improperly. The third exercise was the One Leg Stand test, and Danya did not count in the correct sequence while displaying a lack of balance. The fourth exercise was the Finger to Nose Test. The final exercise was the Modified Romberg Balance Test, and Danya estimated the passage of 30 seconds in 18 seconds.
Based on Danya’s motor vehicle accident involving severe property damage, her admission to consuming alcohol, and her inability to satisfactorily perform the field sobriety exercises, Officer Krolick placed Danya under the arrest for driving under the influence. After she was placed under arrest, she was first transported to the Clearwater Police Department. At the facility, she agreed to submit breath samples. Danya ultimately submitted 2 breath samples, which revealed a BAC level of 0.061% and 0.060%, respectively. While this was under the legal limit of 0.08%, Officer Krolick informed Danya that he had reason to believe that she was still above the legal limit of 0.08% about an hour earlier, so she was going to be charged with a DUI. However, he license would not be suspended at the time.
Danya was charged with DUI-property damage (316.193(3)(C)1) and Careless Driving (316.1925) and subsequently transported to the Pinellas County Jail for further processing. On January 22, 2024, a hearing was held in which it was determined that Danya would be outfitted with a Cam monitor prior to release from the PCJ. On April 23, 2024, it was determined that the Cam monitor could be removed and it was no longer a condition of pre-trial release. Court records indicate that as of 5/2/2024, Danya’s case is still pending in Pinellas County.
