Uncooperative 19-Year-Old Arrested for DWI After Crashing into Pole

Around 8:27 PM on December 24, 2023, Officers Sean Barry and Tony Perito with the Middletown Township Police Department responded to a motor vehicle accident involving a 2022 Nissan Altima on Port Monmouth Road. As they arrived on scene, it was apparent that the vehicle had struck a utility pole and sustained significant damages. They made contact with the driver, who was identified as 19-year-old Pharyze.
Officer Julian Reis arrived shortly afterwards to assist, and he asked Pharyze if she had consumed alcohol. While she denied consuming any alcohol, Officer Reis detected the odor of alcohol. Based on his suspicion of impairment, Officer Reis asked her to perform field sobriety exercises.
The first exercise involved the Horizontal Gaze Nystagmus (HGN) test, and Officer Reis observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the Walk and Turn test. During the Walk and Turn test, Pharyze failed to touch heel-to-toe on each step while taking an incorrect number of steps. The final exercise was the One Leg Stand test, and Pharyze did not perform this test satisfactorily.
Based on the motor vehicle accident, the odor of alcohol on her person, and her inability to adequately complete the field sobriety exercises, Officer Reis placed Pharyze under arrest for driving under the influence. Her vehicle was searched and impounded for a mandatory 12-hour hold under John’s Law. Officer Perito transported Pharyze to the Middletown Township Police Headquarters for further processing..
At police HQ, Pharyze was uncooperative. She was read the Standard Statement for Motor Vehicle Operators, but she refused to submit breath samples for testing. Pharyze was eventually released to her father after he signed the Potential Liability Warning Form on her behalf. She was issued the following summonses: Operating under the influence, operating under the influence underage, refusal to submit breath samples, reckless driving, careless driving, failure to possess driver license, failure to report accident, and traffic on marked lanes.
